A Life-Changing Injury? Build the Case for the Future.

When an injury changes the rest of a life, the recovery has to pay for years of care, and the fee comes out of every dollar of it. Kavanagh Injury Law handles catastrophic injury claims in Indianapolis and throughout Indiana at 20%, pre-suit through appeal, not the 33-40% most firms charge.

Licensed in Indiana. If your case arose outside Indiana, ask us. We may be able to arrange co-counsel licensed in that state at the same 20% fee.

What Makes an Injury Catastrophic

Injuries that change the rest of a life

A spinal cord injury, a traumatic brain injury, an amputation, severe burns, or any injury that leaves a person unable to work or needing care for years. These cases come out of the same crashes and falls as any other, but they are valued differently.

The future is most of the claim

In a catastrophic case, most of the loss has not happened yet: future surgeries, therapy, equipment, home changes, care, and the income a person can no longer earn. Those costs have to be projected and proved, not estimated at the end.

Why the Fee Matters Most Here

These are hypothetical numbers. Every case is different, and past results do not guarantee future outcomes.

The same percentage, a much bigger number

On a small case, the difference between a third and 20% is real money. On a catastrophic case it can be the cost of years of care. On a hypothetical $1,000,000 recovery, a one-third fee is $333,333. Our 20% fee is $200,000. That is $133,333 that stays with the injured person, before case costs and medical liens.

It never goes up

Many contingency agreements raise the percentage if a case goes to suit or trial. Ours is 20% pre-suit, through trial, and through appeal. Catastrophic cases are the ones most likely to need a trial, so that is where the difference grows.

Finding Enough Coverage

More than one policy

A serious injury can exceed the at-fault party's limits. We look for every layer: the at-fault policy, any umbrella or excess coverage, a commercial policy if a commercial vehicle was involved, and your own underinsured motorist coverage.

Liens must be resolved

Health plans, Medicare, and Medicaid that paid for treatment can have a right to be repaid from the recovery. Those claims have to be identified and negotiated before the money is distributed.

Government defendants have shorter deadlines

A personal injury claim in Indiana generally must be filed within two years. A claim against a government driver or property owner needs written notice first: 180 days for a city or county, 270 days for the State.

How Kavanagh Injury Law Handles Your Case

A catastrophic case is built on the future, so we build it to be tried.

We prove the future, not just the past

Treating physicians, the medical records, and, where the case calls for it, experts on future care and lost earning capacity.

We prepare it for trial

Our goal is for every settlement offer to be judged against a trial we are ready to try.

Flat 20%: always

Our contingency fee is 20% whether your case settles pre-suit, goes through trial, or reaches appeal. It never escalates to 33% or 40% like most Indiana firms. You pay nothing unless we recover for you.

Lien reduction: 100% to you

We negotiate medical liens aggressively. Every dollar we reduce from a lien goes to you. We keep none of the savings and charge no additional fee for lien work.

If a catastrophic injury was fatal, the family's claim is a wrongful death claim, with its own rules about who may bring it.

Frequently Asked Questions

What counts as a catastrophic injury? +

There is no single legal definition. The term usually covers injuries with permanent or long-term effects, such as spinal cord injuries, traumatic brain injuries, amputations, and severe burns.

How is a catastrophic injury case valued? +

Mostly on future losses: future medical care, therapy, equipment, home changes, care, and lost earning capacity, along with pain and loss of enjoyment of life. Those have to be supported by the medical record and, often, by experts.

Why does the fee percentage matter so much? +

Because it is applied to the whole recovery. On a hypothetical $1,000,000 recovery, the difference between a one-third fee and our 20% fee is $133,333.

How long do I have to make a claim? +

A personal injury claim in Indiana generally must be filed within two years. A claim against a government entity needs written notice much sooner: 180 days for a city or county, 270 days for the State.

How much does it cost to hire you? +

Nothing upfront. We work on contingency at a flat 20% of any recovery, pre-suit through appeal. If we do not win, you owe no attorney fee.
