Lawyer to lawyer
I take Indiana auto and premises cases at a flat 20%. On a referred case you receive 50% of the net attorney fee, after advanced case costs, paid within 14 days of collection, guaranteed in writing from the day the file opens.
Because the split is half rather than the customary third, the 20% fee costs you far less than people assume. On a $100,000 recovery:
| $100,000 recovery | 33% firm, 1/3 referral | Kavanagh, 50% referral | Difference |
|---|---|---|---|
| Total attorney fee | $33,333 | $20,000 | — |
| Your referral fee | $11,111 | $10,000 | −$1,111 |
| Your client nets | $66,667 | $80,000 | +$13,333 |
Before case costs and liens, which come out of the recovery in either column. Any division of fee is made under Ind. Prof. Cond. R. 1.5(e): non-exclusive, disclosed to the client in writing including each lawyer's share, with joint responsibility assumed, and the total fee reasonable. Nothing of value passes outside the fee division.
I do not handle workers' compensation, medical malpractice, or products liability. When one comes in, I send it out and I take no fee and no joint responsibility — my professional liability coverage does not extend to joint responsibility outside my declared practice areas, so there is nothing for me to claim. That is free case flow to whoever takes it.
I also refer out criminal, family, bankruptcy, immigration, and civil rights matters, which my clients need constantly and I do not touch. If you practice in any of those and want to be on that list, email me and you are on it. The traffic between our offices does not need to balance.
